In the book it was the kids friend Pete Daoust. I don't know if it is the same in the movie or not.

#5 is Pete Doust, the friend of the 2 brothers.
The parents were the white trash couple that burned Avery's office down. The parents were played by Amanada Plummer and Freddie Kruger.
It's pretty clear that Pete Doust was the first person to shoot in that sequence. He says something along the lines that enough is enough and something about the old man.
However Doust must be a horrible shot because it's not clear is how Ludlow survived what should have been a fatal shot.
Next Ludlow fired back hitting the flash light.
Danny & his father fire. Their brother/son is hit.
Ludlow returns fire and takes them all down with out getting hit again.
Doust goes down, Danny & then his father before Ludlow falls down.

You must have been confused too when you wrote your post : each time you say Avery shot Harold although he was unarmed you mean ... PETE ! Harold was besides Avery and was shot by his father or his brother Danny.

Just finished watching on my DVR and played it over a few times.
Danny shoots first.
Avery fires three times.
First shot knocks the gun out of Danny's hand.
Gut shot to Danny.
Gut shot to Danny's dad.
Dad is spun and as he falls, his gun goes off and accidentally kills Pete.
