I would not have taken the high road that Avery did. If I were Avery, the film would have ended quite differently and much more cathartically.
This is how I have re-envisioned climax:
SPOILERS BELOW:
The shootout commences as before; those who are shot are shot. McCormick dies, as does Harold. The only two left alive are Avery and Danny. Danny whimpers. He is terrified and in deep pain. Avery approaches him with pistol raised. As he closes in, Danny raises his gun and attempts to shoot Avery but Avery stomps on his wrist before he can aim and the gun discharges as his hand hits the dirt.
Danny looks up at Avery. Through clenched teeth, he utters, "F--- you!"
Avery replies something to the effect of, "Acting tough, isn't going to help you, Danny."
His words prompt Danny to uncontrollable sobs. Then Ludlow silences Danny's wails with a single gunshot.
Avery wipes his prints from the gun. Then he kneels before Harold's body and, with some regret, plants the weapon in his palm. Then he leaves the crime scene.
