Carlos De Luna not the anti death penalty posterboy

Prior Convictions, prior felony assault charges. Incarcerated, paroled, violated and had his parole revoked. Then a man claiming to a thrid party said that he killed the people he was convicted of killing. Not to mention that Carlos told the police that arrested him from under a car where he was hiding, he told them that he knew the killer and would help them if they would help him.

How about looking at another person that had no prior conviction. Had no criminal record. Did not hang with felons. Served in the military and rose in the ranks. Worked for the postal service. And was then convicted of a brutal rape and murder which he did not commit. Sentenced to Death. Then on appeal, he was again convicted and the sentence was reduced to 46 years in prison. Then later, after DNA evidence was used, Ray Krone was exonerated of the conviction and the real killer, Kenneth Phillips, was arrested and convicted for the crime.

Also, Ray Krone spent 10 1/3 years in prison for the murder in which he did not commit.

How was he convicted? A Dr testified with 100% certainty that bite marks left on the victim during the rape and murder were made by Ray Krone. Partly because Ray Krone had surgery on his jaw when he was in a car accident as a child and had a tooth that stuck out. Ray was deemed in the news to be the "Snaggletooth Killer".

His appeal was granted first because evidence was presented to defense the day before it was shown in trial which did not give ample time to cross examine and do the defenses own test on the evidence. He was still convicted but only sentenced to 46 years the second time.

After 10 years in prison, DNA evidencefound on the victim tested and Ray Krone did not match. And the evidence matched Kenneth Phillips who was already convicted of another crime.

Ray Crone, Honorably discharged from the Air Force, no criminal record, an just happened to have went to the bar the waitress was killed in and had bad teeth.
