how could have law vs freewill have been resolved?

Law in a democracy is supposed to be so that the citizenry can do what they want while allowing others to also exercise their rights to their own freedom.

There will occasionally be conflict between one persons right to use public space and other peoples rights. The government (in this case Mayor Daley, the National Guard and police) have to juggle these rights.

Mayor Daley overstepped the line by guaranteeing the DNC organisers their right to an unimpeded convention by refusing thousands of people their rights to peaceful protest. That was at least a lapse in judgement, and at worst deliberate denial of the rights of others because he disagreed with their opinions.

If the protesters had been given more freedom via limited permits, by Mayor Daley accepting their right to assembly and protest there was less likelihood of any trouble.

As soon as Daley said that the protesters had no right to protest, he ensured violence by the police.
