Although he didn't go that route, why didn't his lawyer suggest it?

A "wrongful conviction" civil suit for monetary damages filed against the plaintiff in a criminal case is rare, and winning such a suit is rarer still. Even if it is proven that witnesses perjured themselves, the standard remedy is to seek a criminal prosection for perjury. Given the specifics of the situation presented in the film, few prosecutors would have pursued criminal action against the girl or her family: After all, it was the South, a young black athlete and a white girl.

The only possible civil suit for monetary relief Monty could have perhaps pursued would have been against the police/prosecutors for wrongful prosecution. He would have had to prove to a civil-court jury that the police and prosecutors knew the witnesses were perjuring themselves.

Seems obvious that he was released when the truth of the wrongful conviction came out.

I don't think people are paying attention to this movie (and I don't blame them), but the bigger plot hole is that he was supposedly still on "probation" (parole) at the time of the custody hearings, which would mean the conviction wasn't overturned. That's hard to believe if he was falsely accused in what seems to be a high profile case.

Just really bad writing on the part of Tyler Perry. It's like he had some things to say (some dads are really good and some moms are really bad; love can happen in the most unexpected places; if we stand together we can beat drug dealers) and forgot that he needed a cogent, compelling story.

reply

Exactly, geebs41. Monty wouldn't have been on probation at all if he'd been wrongfully convicted, nor would the accusations about that conviction have been able to fly in court when his ex wife brought them up. Shoddy, shoddy writing, IMO. This movie is a cute fluff piece but the part about the wrongful conviction has always bothered me.

The writing was not up to snuff because Tyler does more than he's always capable of. Maybe he should pull back from one of those jobs. The ONLY reason I wanted to see the movie is because of that delectable Idris Elba! Well, I wanted to see a Black couple fall in love. Good actors can't save Tyler Perry's writing.

I think the concepts Tyler comes up with are great but he just doesn't execute them well on paper or on film. If the script sucks too badly, even great actors can't make it play out well on screen. Tyler's writing style is very lazy, IMO and whether intentionally or not, he really tried the intelligence of viewers of this film with that MAJOR plot hole concerning Monty's past.

I find that most of his movies have good concepts and I LOVE that he always tries to show true love between black men and women in his films- I just wish he wasn't such a lazy writer!

I agree with you Poet! While I always want to root for Tyler Perry. He is REALLY making me roll my eyes when another movie of his is announced. Because I pretty much know ahead of time that the writing will be LAZY, the acting will be mediocre at best and I'll be watching the time to see when it wil be over. It's really hard to feel any sympathy for ANY of the characters simply because the acting is not believable.

Oh yes I most certainly adore that Tyler always loves showing romance and love between a Black woman and Black man. It's not like we see that in moves.

You're right about the actors not being able to carry a movie when the writing is bad. As much as I love Angela Basset and Jenifer Lewis, their characters in "Meet The Browns" could have been played by ANYONE. They could not overcome the script in that movie. Perhaps Tyler needs to take up writing.

And it will be the same story over & over & over in both films and tv shows of his. Either:

The mother is a bitch and on drugs. The children have a good father.

The father is violent, beats his wife and cheats. The wife is almost a saint.

Innocent children who no one listens to , are caught up in a horrible home situation.

Actually I think it's perfectly believable that he is still on some kind of probation. Once you are considered a sex-offender by the system, they will not want to let that go.

My best guess is that the Rape charge he was convicted of was commuted to a statutory rape charge with time served, but he would still be on probation for said reduced charge. Not fair, but he is black and the girl was white, and studies have shown repeatedly that black on white crime is prosecuted more than any other racial mix.

Having said all of that, his new girlfriend should be able to get the probation dropped.

reply

It said he had been falsely accused of rape, but was the girl under age? She told his she was 18 but really was not. If she was under age it would have still been statutory rape, as she was not of age to give consent.

reply

She told him she was 18, but she turned out to be 16 or 17. What happens in during a case like this when someone is falsely accused? Does the charge get dropped or something?
