Nicholas was encouraged to make that dish by the mentor chef for Avant-Garde cooking. The mentor never told him to rethink his dish.
I always felt bad for Nicholas, because he was treated as The Bad Guy for not resigning his immunity under the pressure from Jacques Pepin. He did nothing wrong, and given the nature of the challenge, he was the only one on the team who could take the risk of cooking such strange dish.
I've watched that episode a few times, and most recently in the past month. The judges were complaining about the grittiness of Stephanie's mussels the minute she served it. And yet, she acted like such a victim for being sent home.
The bottom line is that, during team challenges that involve immunity, you need to cook the best dish on your team. If you don't, you're going home. You have no reason to squawk or whine, like Stephanie and Emily did.
