Isn't the show Jay Jay the Jet Plane a total rip off of Budgie?

In his book 'Inside The Magic Rectangle', Victor Lewis Smith claimed that 'Budgie' was a rip-off of 'Polly Copter', a character from 'T.V. Comic' in the 1960's. Fortunately for The Duchess Of Pork, its creators are dead and thus cannot sue for infringement of copyright.
