Legal question: please help


I believe this is the movie where that sicko goads her into getting naked in front of him and dancing, then rapes her? Such a disturbing scene.

That being said, hypothetically if some person did not actually rape or even touch a girl or take pics and just goaded her into stripping for him because he gets off on seeing naked girls would that still be a crime and if so what? The way I see it just seeing a naked child in and of itself could not be a crime because there are nudist clubs or nude beaches where that could happen legally. Would it fall under some other legal umbrella or be a misdemeanor instead of a felony? I am just wondering legally how that would work.

Depends on where you live, I guess. But if "goading" her is interpreted as force, then, I think in many places that could be considered child abuse, which in many places is illegal.

I am pretty certain that would be criminal, especially since that was Alabama in the 1950s. I assume Wooden's Boy to be in the late teens and so it was not like Buddy and Lewellen "playing doctor" earlier. With or without "goading", if Lewellen was seen dancing naked, he would have a hard time trying to convince people that he had no intention of sexually abusing the girl.

Another reason is that I believe child pornography is definitely illegal. So I see no reason why it would become legal if instead of photos you look at "the real thing".
