Franks release from the hospital

A few days after Chloe turns up, the doctor agrees to have Frank released. At this time, he still has amnesia. Yet, the doctor expects him to sign the release. He can't sign it as Frank Kavanaugh if he doesn't remember who he is, can he? I mean, is that even legal?
