No one would have had access to the set prior to the crew getting there. The crew would have been there all day setting up the lights, camera gear etc etc. The actors and extras would have been there for atleast 2 hours before cameras rolled. Even then, they wouldn't have started the orgy because they would have been on set blocking the scene, getting make up and testing the sound. Once everyone's in position (no pun intended) only then would there have been the opportunity for sex to occur. Once they started rolling there very well could have been real penetration. But it wouldn't have been spontaneous. The actors and producers could have sued whoever instigated it.
