In a SAG production you have rules about the use of an actors image, but they are parts of SAG contracts. Porn films are not made by SAG actors though and for the making of a documentary it would be covered under fair use. The rules exist to prevent producers of previous films from shooting new scenes that incorporate old footage and selling them as new films starring that same actor.

Depends who owns the footage, most of the time its not the actors. Very tricky course, making a doco most prob wont be excuse to breach copyright laws. Very tricky area, and with most laws cant know for sure until gone thru court.
