What are the legal problems blocking this film's distribution?


What exactly is the reason for the legal injunction that prevents the distribution of this film? Any chance of them being lifted in the near future?

There was a woman that was killed in Florida while under the control of Scientologists. The church says that the movie is an attempt to "poison the jury pool" against the Scientologists in this case. Until the suit is resolved, the movie will not be distributed or viewed. I believe her name was Lisa McPherson.

That's a load of sh*t. The first ammendment has such little power these days. The second greatest movie ever made, A Clockwork Orange, caused about fifty murders. Kubrick stopped distribution in theaters, but his film still went down in history.

How, legally, can a film be banned in America?

It's highly questionable that Clockwork Orange "caused" 50 murders. The only real life incident that could have been connected to the film (according to the media back then) was an attack on a homeless person in the UK. And Kubrik had withdrawn the movie not because of this attack - he acted on advice of the police, as he and his family were threatened by unidentified persons because of Clockwork Orange. Also, the distribution was stopped only in the UK, the film was still in theaters in the rest of the world.

A Clockwork Orange is second greatest? I can see that. But what would you say is the first greatest?

According to the "Official List" (read: list compiled by official-sounding group), A Clockwork Orange came in at #46. Of course, Citizen Kane was named #1, so I assume they just chose at random. http://www.afi.com/tvevents/100years/movies.aspx

Citizen Kane is always number one on those lists. While it's certainly a contender for most important film (in terms of films that followed in that practically every film technique we use in movies today was used either first or nearly first in Citizen Kane, the only other contender for most important is, unfortunately, Birth of a Nation, for while it was incredibly racist it was practically the prototype for feature length movies until the end of the silent era), it's pretty absurd to pretend that not one movie made in the 60+ years since Citizen Kane has been better.

I was super-pissed that so many musicals made that list and that Kubrick's highest ranking movie only ranked at 22. COME ON!

Scientology is where the money is in hollywood these days. Satanism has little public used money hense why all the movies makign fun of demon cults are Ok'd on the spot, if someone blasted into an auto R-Rating. You can even make fun of catholics or depict them as evil secret keepers hiding jesus in a vault or some such (sorta like The Da Vinci Code but not quite). But make fun of the religion who "runs" hollywood? Never ever. In fact....bow down now to the mighty L. Ron Hubbard who founded it and forget about this movie...being as how it HAS to be preaching some sort of immoral or DASTARDLY (love that word sounds so much worse than it is) deeds.

A woman died in one of the florida churches and the judge granted an injunction because the jury would be swayed if it was released. I find that funny since they let movies about O.J. and scott peterson be played on tv before the verdict or jury was picked

The Religion that runs Hollywood? I don't really think that's the case anymore. Otherwise, Paramount would not have fired Tom Cruise and the South Park Scientology episode will still be banned (its been reaired and just today came out on DVD.) I am wondering how such a court order created a worldwide ban, especially when a lot of governments (including Cananda and France) are hostile toward Scientology. Why should one judge have so much power over the world?

Remembering what I know from my Political Science class, Freedom of Speech cannot be taken away if it is high value speech, i.e., deeply rooted in American history. There are several tests to see if it is low-value speech: Advertising (State/Federal gov't can ban advertising), Advocates imminent (immediate) unlawful activity (hasn't happened in history yet), Fighting words (words that would make a normal, reasonable person lose control and resort to violence), Clear & Present danger (can't yell "fire" in a movie theater if there isn't one). Finally, gov't has the right to prior restraint (preventing something from being published) if and ONLY if there is a matter of national security. If there's a dispute over whether it's national security or not, the courts decide.

I have never seen this film, and it MUST have had to include one or more of the low-level speech tests, or been a question of national security. Otherwise, this movie cannot legally be banned.

These legalities are outdated. Thousands if not millions of people will see this crap film irrespective of what courts in america decide, it is out of their control.

Yesterday, it was said injunction (which was lifted a few years ago, if I remember correctly). Today, it's a financial dispute involving one of the producers.
