In the eyes of the law rape is defined as "non-consensual sex with penial insertion."

Hence - it was NOT rape as a woman cannot engage in oenial insertion on a man.

You're right. It IS sexual assault, and very serious sexual assault at that, and can, thus, carry, in theory, a sentence as long and significant as that which is given for 'rape' (i.e. non-consensual sex with a penis or object - by the way, women *can* commit rape, if they were, say, to insert an object without a man's consent into his anus; my apologies for the clumsy way I'm dealing with this very serious topic).

But you're also right to say that *technically* it wasn't rape in this instance, even though the intent was effectively the same as the Mens Rea for actual rape.

Not all countries have the same laws.

In US she would be put on probation with a fine also sex offenders list (this is one area US is way to soft no wonder why people are not happy with it)

UK it can vary with being put on sex offenders list plus could server upto 10 years prison

Rape is an outdated term most of the time sexual assault is used because it covers a broader spectrum and would be easier to charge someone.

Definitely rape. She took advantage of him and it emotionally and psychologically impacted him because it broke his challenge and damaged his relationship with his current girlfriend. She also used that rape for monetary gain considering she won the bet.

She should be thrown in jail.
