The real first Film Noir?

It was filmed on location on the real streets of New York City instead of a studio back lot which probably didn't exist yet. It was minimalist with only a few interior sets (probably film outdoors because of the limitations of the time). It was certainly dark story about a child being kidnapped. It certainly seems like a film noir.

It certainly has a gritty theme and dark story, but I don't think that it fits the label of "film noir".
