The right front leg definitely dangles as the animal gets up.
First of all the tree is irrelevant. The "tree" in the previous shot doesn't even touch the horse, the swing is timed to coincide with the horse falling, but it never connects.
Unfortunately it looks like the horse injured itself in the fall. I don't know enough about horses to know whether that would ultimately lead to the horse being put down and I don't know enough about horse movement to say if that was just the animal trying to regain its balance or whether that was a genuine injury, although I have to say it does look very limp.
Obviously this was an accident. I wouldn't call it abuse at all but the shot of the horse getting up is so unimportant that there was absolutely no need to include it if indeed the animal was mortally injured. In fact it's not even the same take, since the rider is trapped under the horse after Heracles strikes and then when it cuts to the horse getting up a split second later, the rider has vanished.
I suspect the fall that is shown is not the fall where the horse is injured (it certainly appears to be in good condition during that shot), but that the horse was injured during a later take. They should not have included the shot. This isn't supposed to be Cannibal Holocaust.
