Someone who is 13 cannot legally consent to sex with anyone older than 17 according to state law. If the defendant is under the age of 18, anyone who is more than 4 years older than the defendant can be charged with statutory rape.

At least he was arrested for being with the 14 yr old although they never actually did anything. He gave her a ride and the most they did was he put his arm around her and she snuggled up to him and I think she might have kissed him on the neck. I get he had intention of doing more with her (the 14 yr old) but he hadn't up to the point they were pulled over.
