In a statutory rape case in Tennessee, the age of consent is 18. There is a close in age exemption of 4 years which applies to those between the ages of 13 and 18. The stance of the state of Tennessee on the age of consent is "Statutory rape is sexual penetration of a victim by the defendant or of the defendant by the victim when the victim is at least thirteen (13) but less than eighteen (18) years of age and the defendant is at least four (4) years older than the victim." Someone who is 13 cannot legally consent to sex with anyone older than 17 according to state law. If the defendant is under the age of 18, anyone who is more than 4 years older than the defendant can be charged with statutory rape.
