Since Nathan was 15 and Stuart was in his late 20's early 30s... Rape???


Are the laws different in the UK than they are in the US??? Wouldn't he be arrested for having sex with a minor?

Really, this is a problem? Nathan is a bigger guy than Stuart and goes after Stewart after their initial hook up. Even then Nathan is looking for hooking up in Manchester's gay area. Sure Stuart is a predator but Nathan want's to be prey, presents himself to be picked up. The law maybe 16 in in the U.K. but it's 15 in several European nations. British drinking age permits mixing of underage with legal adults so the 15 with a 29 year old is realistic.

However the U.S. remake had to raise Nathan's age to get it made.

Not arguing but in the U.S., IF a 18 year old sleeps with a 17 year old it's having sex with a minor. Because 18 means your adult and 17 is still a minor. It could be held as rape...

Depends upon the State. Most States the age of consent is 16, though some are 17 and a few are 18. However if the older partner is an authority figure to the younger, such as a teacher, minister, etc. then it is 18 in many States. For many States if the age difference between the older & younger partner is 3 years or less then consent is presumed even if the younger is under the age of consent. However, if the younger is 12 or younger then statutory rape is automatic, though for some States 13 is the operative age. Lying about age by the younger is not typically a defense for the older. Crossing from one State to another where age of consent is more favorable is also not a defense, the State of residence of the younger typically prevails. There is also prosecutorial discretion that could affect whether charges are filed. While the law across States are rapidly becoming gender neutral, for some jurisdictions prosecutors may come down heavier on same sex partners.

There was one notorious case where both boys met in high school, had consensual sex for more than a year, maybe even two. Both sets of parents knew they were boyfriends, even had them over together for dinners, etc. As soon as the older turned 18 the parents of the younger filed a complaint, with the older successfully prosecuted for statutory rape of the younger and imprisoned. The case was one of several that prompted the State legislature to enact a 3 years between partners exemption to age of consent laws but the law was not made retroactive. I believe the imprisoned partner was eventually paroled or might even been pardoned by the Governor but he was in adult prison for quite awhile, years, before his case was resolved.

A case similar to this happened in my state about 15 years ago and the so-called predator was less than 6 months older than her partner. As it stands, she is considered a sex offender and will be treated by law enforcement as such for the rest of her life.

In the eyes of the law she is no better than the perv on the darkly lit street corner baiting children with sweets. No Age of Reason in these draconian days of "Zero Tolerance." What a difference a day made when that 17-year-old turned eighteen.

He could be, but Nathan lied about his age. I think that should be taken into consideration.

It wouldn't matter. It's all hear say.. Meaning IF the minor went to their parents and yelled rape because they are afraid of getting in trouble. IF the minor did lie about their age that wouldn't matter. They wouldn't be able to prove anything it's all hear say... A minor doesn't know better..

I think the perception of this kind of situation has significantly evolved since the late 90s when the show was produced. If the show was made today, the issue would be raised, talked about and be a central point of the plot. It wouldn't be tolerated to handle things so lightly. I guess that all the scandals about paedophilia have changed how people can perceive a relationship between a 15 yo boy and a 30 yo man, even if the show tends to portray Hunnam's character as a consenting. It would be difficult for
producers and writers to show the kid as a "voluntary prey".
Back in the 70s some writers could easily talk about their experiences with teenagers. It's crazy to see what was tolerated then and how things could be
treated so lightly, even on television. Society has changed: some things are more tolerated and are no longer taboos, some others have become very sensitive.
