Beeing drunk doesn´t excuse him no, but the fact that his friends held him does. The way they showed the scene on Norwegian television, his frieds raped her, using him as a tool to do the job.Wich means they raped him as well. Maybe they eddited that part out for american tv.

In a way he deserved to die because he hid the truth about happend to Laura Lee. It was explained in the movie that Laura Lee was an outsider so nobody in the town believed her and they supported Brent, Tom and the other golden boys.
