Facts that prove he was set up

During the trial, the prosecution produced little to no evidence linking Carter and Artis to the crime, a shaky motive (racially-motivated retaliation for the murder of a black tavern owner by a white man in Paterson hours before), and the only two eyewitnesses were petty criminals involved in a burglary (who were later revealed to have received money and reduced sentences in exchange for their testimony). Nevertheless, on June 29, 1967, Carter and Artis were convicted of triple murder and sentenced to three life prison terms.

In late 1974, Bello and Bradley both separately recanted their testimony, revealing that they had lied in order to receive sympathetic treatment from the police. Two years later, after an incriminating tape of a police interview with Bello and Bradley surfaced and The New York Times ran an exposé about the case, the New Jersey State Supreme Court ruled 7-0 to overturn Carter's and Artis's convictions. The two men were released on bail, but remained free for only six months -- they were convicted once more at a second trial in the fall of 1976, during which Bello again reversed his testimony.

Artis (who had refused a 1974 offer by police to release him if he fingered Carter as the gunman) was a model prisoner who was released on parole in 1981. Although lawyers for Carter continued the struggle, the New Jersey State Supreme Court rejected their appeal for a third trial in the fall of 1982, affirming the convictions by a 4-3 decision.

Even if he was guilty, the police reduced their credibility by lying and planting evidence. Most likely they didn't know he was guilty if they had to fabricate motives and eyewitnesses...

Carter and Artis both failed a lie detector test, Bello passed 2 lie detector tests, both conducted by different operators.

Bello went to a friend's house screaming how Carter shot up a bar a few hours after the shooting, only 4 months later he told his story to the police. Unless you think Bello set this hole thing up months in advance, and this was some sort of conspiracy involving hundreds of people to prosecute a pathological liar all evidence pointed in Carter and Artis' directions.

They were even offered a second lie detector test, which if they passed they would be free, and if they failed there would be no consequenses, but they both declined.

Some people who backed up Ruben's alibi retracted their stories in the second trial.

http://www.graphicwitness.com/carter/marinsid.html The survivor identified Carter and Artis to close friends and family.

The trial may have been unfair, but he was probably lucky that it was, otherwise chances are high he would've been in jail to this day. 'cause he was never found innocent.

I'm curious to know which questions they failed when the lie detector test was administered. And who administered the lie detector tests? And please provide the links to the information where you found that 'if they passed the second lie detector test there would be no consequences whether they failed and they'd be released if they passed.' Please also post the link with the information that Bello went to a 'friend's house' screaming that Carter had shot up the bar. I'm from Paterson, btw, and there is a lot of hearsay I could include int his post, including the people known by many to be the actual shooters (claimed by both Black and white families) but I won't post that. Just post links to your articles so I can see how credible this information is...

http://www.graphicwitness.com/carter/liepage.html You can read it all here, with links to the transcripts and the letter about the lie detectors deal.

''If I am satisfied that the polygraph examination or examinations clearly establishes the innocence of the defendant, then i take the necessary steps to terminate criminal prosecution.''

As stated in the letter send from the prosecuter to Carter's attorney in 1976.

Here's the excerpt of the interview the Herald News did with Hurricane Carter in 1975, where they discuss the polygraph test and John McGuire. The question was whether Carter was "involved in the crime" not whether he killed the victims, and the findings were called 'questionable' by the prosecution. Polygraphs are generally inadmissable in court, but the testimony from both Bello and Bradley was recanted and that's actual fact. They recanted and changed their testimony multiple times and the police department did actually compensate them for their testimony. That is a fact. Disregarding those facts by only focusing on a lie detector test, really doesn't make any sense....

That link gave no facts, just someone's opinion. I don't care about that guy's opinion. I don't even know him. He brings up a point about the prosecution witness who recanted his testimony, then provides no information to refute that. He just goes on a rant about something else. If you're gonna respond with a post, please make sure it matches the discussion- the heading reads FACTS that PROVE he was set up. Thank you....

Like i said before. Anything to do with a polygraph needs to be removed since it's not accurate.
