I think it was something that came about later on. She probably liked him all along and as we see from the beginning how super sweet and charming he always came across to Libby. She probably envied what Libby had so since Libby appointed her guardian of Matty, Nick had an easy time convincing her that he wanted her when really he just wanted the $2 million Libby left to her. Remember she was rejecting to be guardian until Libby had to really break down her reasons to her. Theerefore, I can't see her being in on it from the beginning or else she would have been the one to suggest she be the guardian.

It would have been too risky to hire someone else to do it, and he couldn't have swum all that way to shore. However, it isn't explained how she would have found the sailboat--did he know enough about sailing to give her their nautical position? They were out of sight of land.
