Jury Nullification

While I understand that they can prosecute you for killing the same person twice, I don't think the DA would bother, and even if they did, it would be a prime case for Jury Nullification. I can't imagine any jury finding her guilty for the second murder.

If you were on the jury for her hypothetical second murder trial, would you convict her?

I know I wouldn't.

reply

I would still convict, but maybe give her a light sentence, including time served before. You can't go around killing people.

reply

I never get past voir dire precisely because I always mention "jury nullification".

Hmm...

reply

We're not forcing you to serve, are we, Getalis? Rock on!

reply

Jury's don't get to decide on "time served".

But she already was punished for the murder. Why punish her twice? Especially after being wrongfully convicted and no one would listen to her. Literally the only way she got anyone to pay attention was to stalk and attempt to murder him.

I'm sorry, but if you would convict her knowing what you know from the film, you are an immoral a$$hat of epic proportions.

reply

As the other person said, you can't just go around killing people just because that person set you up for their murder. Plus, the only way she got anyone to pay attention was to commit numerous crimes to clear herself of a crime that she didn't commit. You can't do that no matter how wrong people did you, that is what is immoral.

reply

i would gladly give her the electric chair.

she did willfully hunt the person down with full intent even after an officer of the court attempted to stop her. while i might subscribe to "crime of passion", i think she is very much of sound mind and deliberate intent.

Go away, or I shall taunt you a second time!

Are you a prosecutor in Florida/Texas?

Your logic and moral compass are kaput.

reply

moral compass?

two wrongs never make a right.

So, punishing someone twice for the same crime is right?

reply

the first "murder" was not a crime. he wasn't dead.

maybe she should get some credit for some time served, BUT she definitely committed a crime the second go round.

It's not my job to tell you what you want. It's my job to tell the truth.

reply

The first trial itself is totally flawed. You cannot declare a person dead till the body or evidence is found.

reply

She wasn't hunting him down to kill him. She just wanted to know where her son was so she could get him back. She wanted her son and to find out why Nick did that... She needed closure.

reply

Yeah, but her inferred plan in Act I was to kill him. Remember the jailhouse lawyer chick told her?

What threw me off was the plan that Tommy Lee (Travis) stated of framing Nick for her murder the 2nd time, using the tape. Why even bring that up if it wasn't a plan? And how to actually pull it off, since Libby would never get to see her son that way?
