So who's the 'bad guy' here?

Fred kills many people in this one (the norm) but he kills them in public at times and just leaves them there.
But when the white accountant dude is nabbed, those dudes take him, at gunpoint, elsewhere.
Wouldnt they have just blasted him down? Fred would have obviously!
I know, it's a crappy old exploitation flick, not that much effort was put into it, but it bugged me.
