Marvel/Malibu?

I know that Marvel Comics bought up Malibu Comics in 1994, so when the first MiB movie was released, the credits said "based off of the Mavel comic book," or something to that effect.

Now, as far as I know Marvel still owns Malibu. So why did the credits for MiBII say "based off of the Malibu comic" instead?
