What would've happened if the guy didn't put his mouth on the curb? Remember, Derek was out of bullets, so he couldn't shoot him. So if the guy refused to put his mouth on the curb and told him to just shoot him, what do you think Derek would've done?

Derek would have beaten him to death anyway. He was too angered at that point. He would have stomped his face in, mouth on curb or not .
