Mrs. Cole Should Have Gotten Nothing


I'm not a lawyer or anything, but it makes no sense that Mrs. Cole was awarded any money at all.

The prenuptial agreement was declared invalid because Mrs. Cole was lying about her age so she could get married, so wouldn't that make the marriage license null and void as well? She never should have been able to get married in the first place because she was underage and didn't have parental consent. So how does she get awarded half of the marital assets when her marriage was illegal in the first place?

Someone please explain this to me.

Because it supposedly makes her a victim. I agree though. She seemed to hate her kids at the end while the father seemed to deeply care about them. An evil woman like her shouldn't be allowed to have kids.

True. But I suppose it leaves the film at a place for Fletcher to "learn a lesson", even if it wouldn't work out that way in a real court.

Yes but there is this thing called common law marriage. California doesn't recognize it in reality but at the time of this movie most people most likely wouldn't have known that. In reality, if a case like this came up in a state that recognizes common law marriages, the same result would have occurred, assuming that it was also a community asset state, which California is in reality.

I was gonna say the same thing--just about.
They'd been together so long and she'd put some energy into the relationship that she should get a little something. She wasn't a good mother, but that didn't mean she didn't deserve to get money. Also, if she were a "good mother," then we'd probably want her to get more to help raise her kids.

I also agree that she should have received nothing. Not due to Mrs. Cole lying in the marriage certificate, but because she did not EARN any of that $11 million. Personally, I believe alimony should be abolished because individuals have the natural given right to keep the fruit of their labor. Same applies with the income tax.

I always assumed she signed the Pre-Nup when she was 17, but the actual wedding happened after she turned 18.

That way the Pre-Nup would be invalid, but she would still be legally married.

It brings up something that irritates me though: the guy looked twice her age. It's a bit creepy for a 40-year dude to go after a teenager.

Being and looking are two different things.
I don't know how old his character is supposed to be, but Eric Pierpoint (Richard Cole) is 8 years older than Jennifer Tilly (Samantha Cole) in real life.

Yes, she would have gotten squat. Prenup and marriage both null and void. I worked for a lawyer and after I saw this it's the first thing I asked him. He told me that plus no such thing as a common law marriage. People sue for palimony now.

the prenup was before she was 18 the marriage was after she was 18 therfore prenup void marriage not void
