Did it bother anyone else...

...that Shakes waited until the start of the trial to ask Father Bobby to be the witness? I mean...from the minute the topic came up, it seemed clear to me that he was the only one who could serve in that role. Yet we see the trial begin, and only then does it dawn on Shakes to approach Father Bobby. That just didn't make sense to me.
