Captain Ramsey threatening to kill Petty Officer Hilaire...


In real life, can the Petty Officer sue the Navy? And would Ramsey be protected by the US if he did pull the trigger? It's along the same lines of taking down a hijacked plane and all the innocent civilians in order to protect the thousands in the city. What do you guys think?

I don't think it's mentioned, but I wonder if that episode made it into the naval inquiry? I'm not sure whether it would reflect well on Ramsey.

I'd guess he could have defended that action as part of quelling a mutiny in (what he believed to be) a combat situation, it's not a good look but there would surely be an argument for it (the threat, perhaps not the deed had he gone through with it).

More likely,they would try to cover it up.Probably transfer the PO to a submarine or posting of choice,or put him on a faster track to promotions as a way to buy his silence.

Whats the UCMJ article for assault with a deadly weapon?

According to the Goofs section, UCMJ code 128 is assault (such as when Cpt. Ramsay strikes LCDR Hunter). There's also the more all-encompassing code 133, which is simply Conduct Unbecoming.

Article 133 isn't all encompassing though. Conduct Unbecoming in short, or Conduct Unbecoming An Officer and a Gentleman, is actually fairly specific. Article 133 is also 'stepped' and adjudicated according to rank and position. Where areas something an O-1 would not be charged with violating Art.133, an 0-6 holding a major afloat command may be charged for the very same act.

The military would most likely adjudicate this as 'Simple Assault' in specification to Article 128. Intent is the key. Did Ramsey intend to inflict death or grievous bodily harm? Its clear what Ramsey's intentions are, his assault is for 'effect'.
