Interesting Plot Hole


In what legal system would the judge NOT have to recuse himself as an interested party?

It was the judge's fence that Doc Stone (Fox) ruined. How could Judge Evans (Blossom) literally sit in two places at once? How could he be both the judge AND the injured party?

I suppose if Ben had bitched about this, the judge would have agreed, and Ben would have to wait more time for another appellate to arrive. There's a good chance that Ben's penalty would have been far worse if he forced them to accommodate his wishes.

OTOH, it's a movie, and I can't see where another scene covering this would be entertaining.

That and the fact that most viewers probably accept that this small town has only one judge, as it had only one elderly doctor before Ben's arrival.

Judges often get away with conflicts of interest and personal stakes in the real world. It's good to be idealistic about the law, but in a small town with bad or unqualified lawyers the judge could get away with anything and everything

In a small town like this i was surprised the Judge was also not the doctor and sheriff.
