In the begining of the movie, why wasnt Frank in jail? Why was Melissa just able to drop him off?

Because Frank Leone was only in a minimum security prison, we are to assume that some of the prisoners, including Frank, were given a day pass.

Yeah I don't blame you for missing that point, the writers kind of snuck it in. At first I thought Frank must have been a guard or worked at the prison, I didn't realize until later that he was on a weekend pass.
