Billy Lane; victim of discrimination?




Before the contest, Romeo explains to Billy that he can't perform as there are only TEN spots.

As we watch the contest unfold, there are ELEVEN comics.

Ageism? Or was it caused by some ancient grudge between Romeo and Billy?

It is a dicey subject. I am taking a employment law course right now and have found many instances of age discrimination in old TV shows and movies. If he is an employee, and the Gas Station has 20 or employees, he is protected under Age Discrimination in Employment Act, which was created in 1964, and could sue Romeo for violating his rights. However, I think Billy, like 99.9% of all stand up comedians, is an independent contractor. He is in business for himself and Romeo does not control how he does his job. Thus, he may not be protected by the ADEA, and Romeo has the right to reject him. It may not be right, but the law is in Romeo's favor.
