Animal cruelty?

I didn't see this movie but I remember there was a controversy regarding the making of this movie. There is a scene where a foal is born and is supposed to become a champion someday. In the scene, a pregnant mare was to deliver on-camera. She was induced so the birth could be filmed. It turned out the veterinarian had misjudged the due date and she delivered a premature foal. TV-Guide at first reported that the animal was taken to a clinic shortly after the scene was filmed and nursed back to health. Then a later issue said that the foal died a week after it was prematurely induced and the veterinarian was charged with providing false information. I never heard the outcome of that.
