Dean's Prison Sentence


I wonder how many years Dean would serve in prison for his escapades in this film. I've got him on kidnapping, fraud, maybe a novel theory of rape (he obtained Annie's consent through deception), and possibly a 13th Amendment violation for forced labor.

Probably the fraud and kidnapping- though WHO would press the charges?

Annie could have easily pressed charges against him for rape. Would Joanna Stayton ever have consented to have sexual relations with Dean prior to the boating mishap? Absolutely not, IMO. She despised him and even early on in their "relationship" together she wouldn't have sex with him. When she consented she thought he was her husband.

Okay, the whole movie is a suspension of disbelief, so carrying that to the "awakening" scene, one can imagine that in reality she would have been outraged and furious at his deception. I have no doubt that the "real" Joanna Stayton would have had him arrested tout sweet.

Being unaware of Oregon's laws I have no idea how long he'd be imprisoned, but it's likely his kids would all be adults before his release. JMHO.

Disagree. While Joanna would never have consented to even speak to Dean again after their first encounter, by the time she "awoke", she had spent a lot of time with him and she was now in love. At this point, she had her full prior memory restored, but that did NOT alter her memories of her time with Dean. That's why the script handled her post awakening reaction perfectly IMO. She was clearly torn between her new life and her restored old one. That's not to say however that even one in ten women would have been so charitable to Dean, but to say that Joanna in fact was.

Rape is a definite. Legal definitions include tricking a woman into thinking she's with her legal husband (or someone she consents to have sex with).

and she didn't notice it was forced labor. she was in her opinion, his wife. she was doing housewife duties.


I doubt that ANY of this would take place if the shi7bag of a husband of hers owned up to her when he was there to see if that was Johanna.

Joanna pushes Dean overboard? From at least two stories above the water?

Joanna goes overboard during the night? That's probably based a real story where some millionaire got tired of his wife and tossed her over the side. It's probably happened a few times.

Then Dean takes her in and takes advantage of her? And his friend is in on the scheme?

I think what might have made for an interesting alternative movie would be if he just identified her and said "Yeah, that's the BEEP who pushed me off her yacht, and skipped out on paying my fee.

What Dean does to Joanna in this film is in no way comparable to an actual marriage in which one partner is the housewife or househusband.
What Dean does to Joanna is use deception and psychological coercion by falsely telling her that they are married and that his kids are hers, thereby making her think she has a responsibility to him and the children. Thus, he makes her think she needs to do the housework and cooking. Also, tricking someone into having sex with you by making that person think you are someone else (in this case, Joanna's husband) is classified under the law as a form of rape.

Dean does not "pay" Joanna for all the housework and cooking that he makes her do. Rather, he just provides her with what she needs to have in order to survive and continue to do the slave labour, which is what all slave-owners do to their slaves.

Sociologists refer to housework and cooking by housewives and househusbands as "unpaid work".

In cases of live-in employees, such as maids and butlers, those employees are still paid for their work, while perhaps having room and board deducted from their wages.

if you really want to get into this... then only the NICE slave owners provided the slaves with a proper place to stay/things they need to survive. most of the time if they got sick, too bad.

I have yet to see a stay at home mom get paid through her husband.

Well, it's seven years later and the fact that Dean caught a glimpse of Joanna's butt cheek birthmark while on the yacht is now a sex crime, or at least enough of an issue to require sensitivity training.

Ten years from now, looking a woman in her eyes without first asking consent will mean a mandatory listing on the sexual predator list.

But we have to remember that even back then, Dean would have been in serious trouble if Joanna went to the police - and absolutely and justifiably so. His little plan was a crime, even without them eventually becoming intimate. Fortunately for Dean, she fell in love with him and didn't go to the police, which renders the whole discussion moot.
