Future is so Bright episode

I watched that one again. Then thought about this:

Vinny killed the one who squealed on the others at the end of the show. Now, since the main "witness" for the prosecution was dead, couldn't the defense lawyer get his testimony thrown out since they could not cross-examine?

And Vinny would remain in jail for murder. Smart guy.
