Public domain?

I bought a DVD on Ebay for $29 that said a used DVD. It is an obvious copy of a DVD. Of course this listing did not say it was a copy but I found some of their other DVD listings of other movies from the 80's say that they are public domain movies and thus not illegal.. I have a feeling this is just them looking like they are not breaking the law while actually breaking the law.

Anyway.. just to double check is this movie in the public domain? Thanks.
