He wasn't trying to kill him. Prosecutor could never win that case.

Assault and battery for sure though.

I disagree. Kreese choked Johnny. Johnny could have died if not for Miyagi's intervention. In Episode 9 of Cobra Kai, Johnny described the incident as Kreese trying to kill him, so I would argue that Kreese was guilty of 2nd Degree Attempted Murder.

Exactly. Attempted murder is a *very* difficult charge to prove, probably more difficult than manslaughter and murder (when in fact a dead body exists). There was a woman who hired a hitman to kill her husband get off an attempted murder charge. If that's not intent, what is?

Kreese suffered the ultimate punishment......he lost all his students.
Personally I think he could have played the ptsd card in this day and age. Back then it probably wasn't worthy of police attention.

Almost certainly. Not only did he put Johnny in a choke hold, he punch/slapped Johnny's friends when they tried to get Kreese to let Johnny go. Hard to imagine any of the others staying with him.
