Yes, you can. Digging up someone's grave without any authorization whatsoever is illegal, and breaking that pole off the fence was illegal too (vandalism). Tommy would only be blameless had he been doing something that he was legally authorized to do.
Personally, I would say someone is only responsible if they had, or should have had, a reasonable expectation of what could happen. He should have had a reasonable expectation that a metal pole sticking up in a storm would be struck by lightning. He would have no expectation that a bolt of lightning would animate a corpse.
Why didn't that metal pole get struck by lightning during every other storm? He only moved it from the fence to Jasons grave and actually put it lower to the ground then it was. road signs don't get struck by lightning, metal fences don't, my point is there is no reasonable expectation that it would be struck by lightning.
Jason had already come back from the dead a few times in the series. It was going to happen regardless if Tommy dug him up or not. The film actually introduced the new rule that Jason must be chained in the lake in order to be stopped.
Why does lightning strike anywhere. The pole was moved from the fence, one among many, to the "center" of the graveyard, all by itself.
Lightning can strike roadsigns, and poles, and trees, and cars, and people.
Jason may, or may not, have come back from the dead before. But Tommy had no way to predict that a metal pole used to stab him, and then struck by lightning, would revive him. He couldn't have known. Did it happen before?
People are all to quick to assign blame or responsibility to others for things they could not predict.

shareThe question is if Jason would have awakened at some point anyway had it not been for Tommy Jarvis to have been there at the time. If no, then it was indeed all Tommy's fault. But if Tommy's suspicion was right, it would have been inevitable.
