Why did Josh LaHood survive?

The writers went to the trouble to portray Josh LaHood (Christopher Penn) as an attempted rapist but then let him survive at the end of the film as he runs away with the other miners when Preacher bombs their shacks. Usually they let these types of characters get killed off and the audience enjoys it. Just thought it was a little strange. Personally, I would have preferred to see him shot or blown up by Preacher.
