Can a Sheriff?

"Kick someone out of town"
Wouldnt it take a judges order to even begin to enforce that?

reply

No one can "kick you out of town." Neither a sheriff nor a judge has any authority to do so. That's not to say it hasn't happened. There are ways to force someone to leave even if they don't have legal authority.

reply

I’ve seen and experienced this in many ways. They go around it in a lot of ways especially if you dont know your rights and comply.

Going by you, Rambo did the right thing( by walking back to town) and you saw what happened.

It comes down to who is the more credible. In the case of this movie, Teasel is a well regarded sheriff. His story is that this drifter comes through town and he helps him by driving him to the town line.

With enough witnesses, Rambo can prove that Teasle had no right to "help" him leave...

reply

No he can't, but sometimes people get away with things they shouldn't do. Teasle tried to get away with it and it ended up biting him in the ass big time.

reply

Nobody else knows that what he's doing is wrong.

It's him and his corrupt department vs Rambo.

It's such a small town that the guy runs it abusing his power.

reply

I guess my follow up question is: even though the police can arrest him, won't they eventually have to charge him with something? Wouldn't he eventually win his case in court.
Next up on the docket: Jerkwater USA v. John Rambo

reply

First Blood takes place in the state of Washington.

They can probably charge him with loitering and beyond that make something else up,
resisting arrest or perhaps assault against the officers. idk... they'll figure something

My grandad is a retired police officer and I believe he was a good man, but throughout
history there have also been real world police officers throughout the world who have
committed crimes from rape, stealing money that was evidence, racism-brutality (Rodney King),
bribes, etc... and beyond that covering up for each other.

reply

Cops do shady illegal things all the time from small towns to big cities.

reply

But the sheriff in this film wouldn’t say “I just wanted to kick him out of town”

He would say that “Rambo’s appearance, demeanor, and behavior indicated vagrancy; so I therefore attempted to remove him from the town’s vicinity. Mr Rambo decided to defy my instructions, leaving no choice but to arrest him.”

When you put the incident that way ^, the judge would probably agree, especially with no other witnesses
