Why was Gilmore allowed to have shots with his last meal?

I thought alcohol was prohibited as the prisoner is supposed to be sober at the moment of death.

He wasn't. A family member had sneaked in 3 small 1 ounce bottles of Jack Daniels for him. I haven't seen this movie since 1980 so I don't remember the specifics of that scene in the film. Just from what I've read.
