In the scene in which David is coming down the stairs after Kate calls to him (having found The Needle collapsed on the floor) he appears to be without legs. And I think she tells The Needle later that "that's how David lost his legs" (she doesn't say "the use of his legs"). However, in the scene on the cliff, David is not an amputee. He has both legs, although not the use of them.
