The only guy he manages to kill is an almost a teenager called Johhny the Boy. And that only happened because Max accidentally caught him by surprise when he was trying out the shoes.
Both the NightRider and the ToeCutter died their own deaths without Max's involvement at all.

Also, Toecutter wouldn't have been riding that recklessly without Max's chasing him, and Nightrider likely wouldn't have crashed if Max hadn't shaken him up so badly.
