What would happen to the guys in jail (spoliers).

Ok--so the Duke finally catches all of the bad guys. He gets back the money too. He likely makes it back to town before dawn, and the truth gets told. Ok--all of that is made pretty clear.


BUT---just want would they do with the guys in jail already? I know they would not hang them now--because they had not killed anyone. But they had committed a robbery. SO--how would that have been handled ? If the guy who they stole from was nowhere to be found--would there be a case against them ? Or--since they all had come so close to being hung for Kennedy's crime--would they just let them go?
