Death Divided by Three

In this episode Josh captures the wanted man and has him handcuffed standing next to the town sheriff when the wanted man's wife shows up and shoots him dead. She then says that she will split the reward money and Josh tells her she can have the whole thing. How is that even legal? The man was already in custody and had his hands cuffed and it's legal to just shoot someone in cold blood like that?
