Why should they not shoot them. Kobish had killed the old garbage collector and the three of them had terrorized this family for days on end. They were scum. Why not shoot them? Assassins, my foot!

First, the police had no idea if the suspects were armed or not. Secondly, in the 1950's the "fleeing felon" rule was common place. In other words, you run from the cops, you get shot.

(By the way, we can still shoot fleeing felons. However now they must be violent felons and other forms of force must have been exhausted or be unreasonable.)

They knew that there was only 1 gun with bullets and Bogie tossed the only gun (or item for that matter) in his hands at the spotlight. He was clearly unarmed at that point.

^You're assuming the cops knew what went on in the house, like we do. They don't. Even though Bogie tossed the only gun in his hands at the spotlight, for all the cops know Bogie could've taken the loaded gun away from Hilliard and hidden it on him.

Also, we're assuming the lead cop told each and every sniper and cop, that 1 gun had 3 bullets and the other was empty. I didn't hear any walkie-talkies crackling, or see any attempt to verbally relay this info.

I agree that cops today wouldn't have been able to shoot without provocation today. I felt that part of the film was dated.

Life is never fair, and perhaps it is a good thing for most of us that it is not.

You're mistaken. While often in thse old films cops open fire arbitrarily and with no regard to civilians (see Strangers on a Train), in this case the shooting of a violent criminal about to escape was entirely proper by today's standards.

Cops can indeed shoot a murderer if they choose to run, but I do think it's very iffy here. The reason is that the cops already had the place surrounded. They could run, sure, but they wouldn't have gotten anywhere, and they weren't armed. You shoot fleeing murderers so not to allow them to ESCAPE, not because people can be shot on sight once charged with violent crimes.

Don't get me wrong, they deserved it and I doubt anyone would have gotten in actual trouble for shooting them even today (although really, Bogart didn't kill anyone personally, though he was PROBABLY guilty of felony murder). I did find it odd as well, though.

Blah the guy was a cop killer. I don't think the cops really wanted to see him back in prison just so he can escape again. Criminals back then were much bolder than they are today. Look at bonnie and clyd, john dillinger, and "baby face" nelson and the like they had full on shootouts with the cops and often won. Nelson freaking actively hunted cops.
