Why isn't the 2001 film considered a remake?

I'm watching this now.... why is the 2001 movie only considered to have borrowed the name of this one, and nothing else?

I'm not too far into the movie and there are already plenty of elements shared between the two - a main character being a jailbird, the cars and fights obviously, both movies starting at a roadside burger place...

The plot of the movie involving the cops trying to nail the convict main character....

I don't see much resemblance of plot other than the features you mentioned, and most of those features can be found in many film noirs and hot rod pictures.

It could be that the two films were conceived independently and just happened to have the same title.

They are airing it now, 5 pm PST 5 May 2016 on TCM. It was introduced by Roger Corman, the producer who said, "The only thing that they used for the new movie(s) was the title. They called me up and paid a fair fee for the title. The rest of their script was their own."

So, it isn't a remake.

The best diplomat I know is a fully charged phaser bank.

in 1994, this film was re-made, as ''the chase'', with charlie sheen and kristie swanson.
