Plot hole? - Spoiler Alert

When the group finally catches up with Kaban, Tom quickly tells him it will be okay. He can stay; he will sponsor him. The immigration's official nods but is this really true?

As far as I can tell, one would have to have a job and be a settled in order to sponsor someone to come or stay in the country. As we know Tom was an unemployed musician who went from gig to gig. He had just gotten a new opportunity but had to give it up in order to help Peter. It seems by helping Peter Kaban he put himself in the position of not being able to help him.

Does anyone know what the law was at that time?
