Fox Films says this is a film noir, don't believe it because it is not.

Depends on how you define "film noir". Such a broad spectrum of movies from melodramas like Daisy Kenyon to police procedure numbers like Crime Wave (1954) are labeled such, it would seem to be an almost useless term. The problem stems from thinking of noir as a genre, when it is actually more of a style or a mood. And Daisy Kenyon fits comfortably on those counts.
