'Gipp Lawsuit Thrown Out' Plain Weird!


...You couldn't make up anything as weird as this artical in the March 28, 2008 issue of The Daily Mining Gazette..."By Garrett Meese:DMG Writer...Houghton-A lawsuit over the late Notre Dame football star George Gipp's exhumation was dismissed in Houghton County Circuit Court Wednesday after the judge determined relatives of Gipp's had no standing to sue...In response, one of the defendents said he planned to file a countersuit while the Gipps' attorney said he will likely appeal the ruling...On Oct. 4, Gipp was disinterred from his grave in Calumet for DNA testing to determine if he had fathered a child born to his girlfriend four days after his death from pneumonia. Results released the next month came back negative...Karl Gibb of Skanee and several other relatives filed suit in Houghton County Circuit court in November saying great nephew Rick Frueh had no right to authorize disinterment, and Gipp's sister, Bertha Isbelle Gipp Martin, was wrongfully exhumed in the process. They sought more then $25,000 in damages...Among those named in the suit were Gipp's great-nephew Rick Frueh, who authorized the disinterment: ESPN presents at the exhumation for a planned "E-60" segment, sports author Michael Bynum who helped arrange the exhumation and serveral local parties including Lake View Cemetery, the Western Upper Peninsula District Health Department, and Houghton County Medical Examiner Dr. Dawn Nulf...All of the defendants except Nulf filed motions to dismiss the case. Reasons range from legal immunity to the Gipps' failure to state a valid claim...In the ruling, Houghton County Circuit Court Judge Garfield Hood wrote it wasn't necessary to determine the issue of immunity..."Simply put, none of plaintiffs have standing to bring (any) of the claims which they have asserted against any of the moving defendants," he wrote...Karl Gipp said he is dissappointed in the ruling..."I feel real bad about it," he said Thursday. "It shoudn't been that way."...Torger Omidahal, an Iron River attorney representing the Gibbs, said he would likely file an appeal. He declined to comment further until he could review the ruling...In an e-mail, Bynum said he and Frueh plan to sue the Gipps and Omidahl to recover their legal fees and costs and asked that the Gibbs' lawsuit be ruled frivolous. Bynum also said today he would file a motion with the State Bar of Michigan to have Omidahl disbarred..."It was their decision to prostitute the Gipp family name in an attempt to colect money from all of us--now they will all pay the price for their sins," he said in an e-mail...Told of Bynum's comments Omidahl replied. "He can stick it in his ear.""
