Isn't this the exact same plot as the silent movie by Lubitsch "The marriage circle" http://www.imdb.com/title/tt0015119/

Yes--basically a remake with music (and sound of course). There's a good, though short, essay on the movie and its origins in the Eclipse DVD package.
