He freely admitted that he did not follow any process of declassification. That's a slam dunk.

I know the users here with tongues firmly stuck to the orange ringpiece will break their backs bending over to portray that as normal. But we know that deep down you actually understand that the truth is opposite of what you want it to be.

It must be really distressing and disheartening to be faced with the truth that your idol is a crook and a traitor to your country. Genuinely I hope you come to terms with it. Don't want you to hurt any more people like you did on Jan 6. And don't hurt yourself either. At least, don't do it on my lawn.

Abiding by the laws of the USA and the duties of the office of President is what the man swore to do.

Only Trumpturd munching sycophants would claim that the President doesn't need to do the things he got up in front of hundreds of people at his inauguration and swore to do.

Correct. He can declassify or even re-classify just by his actions.

People are utterly clueless as to just how much power the President of the United States holds. It may well be too much power for any one person, but that can only be changed through a constitutional amendment.

So if the Trump shoved his mushroom dick in your mouth, it would not have been a crime and you would have just had to like it. Because by his actions he made it legal for him to do that. He has that much power.


I guess that means that Biden can just think "Those documents at Trump's house are classified again" and hey presto. Trump is now in illegal possession of top secret documents and if he refuse to give them back, Trump can be sent to jail. This presidential power thing is great.

So did he take any actions at all to declassify anything? The president has to do more than "think" the material de-classified. There are procedures that have to be followed.

I think you are clueless about how much power the president has. So is Trump. Trump repeatedly claims he could do anything he wanted per article 2 of the constitution.

But go ahead and tell us what power the president has and which law made it so. You should be more specific than "the constitution".

The Senators from the seventeen smallest states representing 20%(?) of the population can block the President's removal from office (yes I know Vermont doesn't vote the same way as Wyoming.)

The President has the men with the guns and the handcuffs and the jail cells. He also has the pardons.

The Congress has the power of the purse (yes I know this is "legally" assigned to the House, but I don't think any spending bill has been overturned if some piece "did not originate" in the House.) Congress can vote to cut spending for the guns/handcuffs/cells... next year? six years from now? And the Senators from 21 small states, can block THAT.

Here is the guidance on classifying and declassifying documents; from 2010. Trump did not change it. It does not allow the president to just "think or say" it is declassified. Trump could have had it amended, but did not.

If Trump Classified them then Biden reclassified them. And by refusing to return them when they were requested and insisting he could keep them be broke the law

How do you know Biden reclassified them? Trump doesn't even know if he declassified them because they won't let him or his attorneys review the seized documents. Could be cookie recipes for all we know.

If no declassification process was followed--and, indeed, Trump made up his lie about "declassifying" this material only a few weeks ago--the executive branch, staffed by a president and underlings who are incapable of telepathy, will continue to regard these as classified documents. And they get the final say on that.

Exactly. As the Special Master said, Trump has to show evidence that he declassified the documents. In the absence of that, the government's claim that they are classified is evidenced by the classification markings on them.

So is there a law that makes the president exempt from the declassification requirements that everyone else has to follow? There is not. Even though the president can declassify certain information, there are still rules.

Trump made up the "I declassified them" lie a few weeks ago. Not only is there no record of any such thing before that, Trump never asserted that in any of his interactions with NARA, the FBI or, now, with the courts. Presidents change; the executive branch goes on. If the executive branch--the sitting executive branch--says documents are classified, that's the final word on the subject.

The latest news is that Trump filed a sort of "appeal" to the U.S. Supreme Court, arguing without any legal reasoning that the 11th Circuit was wrong to vacate "Judge" Cannon's injunction with regard to allowing the Dept. of Justice to continue its investigation into the classified material Trump had stolen. To even have a chance of winning, Trump would have to successfully argue that he would suffer irreparable harm if the USSC failed to act; his lawyers' long brief doesn't even make any case for his suffering any harm at all (and, in fact, there is no such case). Trump's notion that the 11th doesn't have jurisdiction over its own district isn't going anywhere.

At the same time, the 11th Circuit agreed to hear the DoJ's appeal of "Judge" Cannon's lawless ruling assuming over this case jurisdiction she did not have, granting Trump standing he did not have and then appointing a Special Master. Though only narrowly considering the matter of Cannon's refusal to modify her injunction re:the classified material, the 11th already tore her "reasoning" to shreds. So this "Special Master" farce and the "Judge" Cannon farce will be over soon.

In the Supreme Court case, Trump's lawyers argued for an emergency intervention to speed up the process; in their response to the 11th Circuit, they argued for delaying it until next year.

Therefore Trump has admitted that the docs weren't declassified because all he can attest to is thinking they were declassifed. Which makes them declassified in his mind (Or so he claims. I doubt he believes that. He's just saying it so his bootlick followers have something to swallow other than the unpleasant truth). In other words NOT following the necessary process to declassify them.

Trump admitted he didn't. When he was accused of not following the process of declassification he stated that all he needed to do to declassify documents was to think it. This is consistent with just about every whitehouse staffer who has testified that Trump did not have a clue or a care about the what it entailed to carry out the actual office of president.

I wonder why he didn't just think all the area 51 material declassified. He promised he was going to declassify them but something must have got in the way of his ability to just think that they were declassified. Otherwise we'd be sitting here looking at E.T.'s autopsy report right now.
